§ 9.32.070. Truancy—Prohibited.

  • A.

    It is unlawful for any person under the age of eighteen (18) enrolled in a public, private or parochial school within the corporate limits of the City to absent himself from attendance at school without parental permission. Any person who shall so absent himself shall be guilty of the offense of truancy and be subject to a fine not to exceed seven hundred fifty dollars ($750.00) for each offense. Emergency or unforeseen absences due to illness or other causes beyond the control of the person so absenting himself from school without parental permission shall not constitute truancy if permission is submitted in writing to the proper school authorities within twenty-four (24) hours after such absence.

    B.

    It is unlawful for any person the age of eighteen (18) years or older that is enrolled in a public, private or parochial school within the corporate limits of the City to absent himself from attendance at school. Any person who shall so absent himself shall be guilty of the offense of truancy and be subject to a fine not to exceed seven hundred fifty dollars ($750.00) for each offense. Emergency or unforeseen absences due to illness or other causes beyond the control of the person so absenting himself from school shall not constitute truancy if permission is submitted in writing to the proper school authorities within twenty-four (24) hours after such absence.

    C.

    The provisions of this section shall not apply under the circumstances as related in Sections 26-2, 26-3, 26-4, 26-5, 26-6 of the Illinois School Code (105 ILCS 5/26-1 et seq.) as those sections relate to the student not being able to attend school due to mental or physical disability, lawful employment, attendance at confirmation classes or religious activities during school hours, or is enrolled in alternative learning opportunities.
