§ 6.16.030. Reclamation.

  • The owner shall have seven (7) calendar days from the date of the mailing of the notice of impoundment to reclaim the animal.

    A.

    For first-time impoundments the owner of unaltered animals may reclaim the animal by paying the impoundment fees established by the Collinsville humane society, with the approval of the City Council, and in lieu thereof may volunteer the animal for neutering and deposit the veterinarian's fee therefor, after which the animal control officer shall deliver the animal to the veterinarian for neutering, after which the animal shall be released to the owner.

    B.

    For a second impoundment the owner of the animal may reclaim the animal under either of the two following conditions at the election of the owner:

    1.

    The owner may volunteer the animal for neutering and pay the regular boarding and impoundment fees. The humane society may pay the cost of neutering if funds are available.

    2.

    The owner may reclaim the animal without neutering upon payment of the regular boarding and impoundment fees, plus a fee in the amount established in Title 4.

    C.

    For a third or thereafter impoundment, the animal control officer may in his discretion waive the boarding fee but not the impoundment fees, and neutering cost shall be required as part of the impoundment fees.

    D.

    Impoundment fees shall include fees for medical treatment and care.

    E.

    If the owner objects to the payment of any impoundment fees because the impoundment was not lawfully made, he shall be entitled to an administrative hearing before the animal control officer, or someone designated by the police chief to conduct the hearing, which shall be conducted within forty-eight (48) hours of the owner's notice that he requests such a hearing. The hearing shall be informal. Any person having personal knowledge of facts may testify, and the hearing shall be confined to the issue of lawful grounds for impoundment. If the hearing officer finds the impoundment lawful, the owner must pay the impoundment fees before the animal can be reclaimed. Failure to pay the impoundment fees will result in the humane society becoming the owner of the animal to care for it, adopt it to a new home, or to humanely euthanize it by injection. No animal shall be required to be neutered under Subsection C of this section until the owner has been given notice and has had an opportunity to be heard.
