§ 6.04.010. Definitions.

  • The following words and phrases shall be interpreted as defined as they occur in this title:

    Animal at large means any animal not on a lead or leash or under the restraint of a person capable of controlling the animal, and/or off the premises of the owner.

    Animal Control Officer—Humane Officer. Any person designated by the State of Illinois; Madison County, Illinois; St. Clair County, Illinois; or the City of Collinsville; shall be authorized to perform law enforcement duties under this chapter.

    Animal shelter means any facility operated by a humane society or the animal control division of the police department of the City or its authorized agents, for the purpose of impounding animals under the authority of this chapter for care, confinement, return to owner, adoption or euthanasia.

    Bite means to seize or cut with the teeth.

    Breeding animals means any unneutered animal over the age of five (5) months.

    Circus means a commercial variety show featuring animal acts for public entertainment.

    Domestic animal means an animal of a species that has been bred and raised to live in or about the habitation of humans and is dependent on people for food and shelter.

    Kennel means any premises wherein any person engages in the business of boarding, breeding, buying, letting for hire, training for a fee, or selling dogs or cats.

    Leash means a cord, chain, rope, strap or other such physical restraint having a tensile strength reasonably capable of controlling the animal under restraint.

    Muzzle means a device constructed of strong, soft material or metal, made in a manner which will not cause injury to the dog or interfere with its vision or respiration, but prevents it from biting any person or animal.

    Owner means any person, partnership, association or corporation or agent thereof owning, keeping or harboring one (1) or more animals. An animal shall be deemed to be harbored if it is fed or sheltered for three (3) consecutive days or more.

    Performing animal exhibition means any spectacle, display, act or event other than a circus, in which performing animals are used.

    Public nuisance. Refer to Chapter 8.12.

    Restraint means an animal secured by a leash or lead under the control of a responsible person and obedient to that person's commands, or an animal within the real property limits of his owner.

    Shelter means a moisture proof and windproof structure of suitable size to accommodate the dog or cat and allow retention of body heat, made of durable material with a solid floor raised at least two (2) inches from the ground, and with the entrance covered by a flexible windproof material or a self closing swinging door. The structure shall be provided with a sufficient quantity of suitable bedding material consisting of hay, straw, cedar shavings, blankets or the equivalent, to provide insulation and protection against cold and dampness and promote retention of body heat. Shade from the direct rays of the sun during the months of June through September shall be provided.
