§ 16.20.020. Vacations and variances.

  • Any subdivider or owner of land desiring to vacate part or all of a plat or desiring to deviate from the requirements of these regulations shall do so in accordance with the procedures outlined herein.

    A.

    Vacation of plats. Any plat or part thereof may be vacated by the owner of the tract of land in accordance with the Plat Act (65 ILCS 205/1 et seq.) Such a vacation shall not negate the rights of any utility as specified in their Franchise or License granted by the City.

    B.

    Subdivision variances. Any subdivider desiring a variance from the requirements of these regulations shall file a written request therefor with the City Clerk at the time of submittal of the preliminary request. The variance request shall specify the nature of the variance, fully explain the grounds therefor, and state the section hereof which, if strictly applied, would cause great practical difficulties or hardship. The City Clerk shall forward the variance request to the Community Development Director and the City Engineer for review and their recommendation to the City Council. Granting of the request shall be allowed by a favorable simple majority vote of the City Council.
